Before continuing to read, here is a glossary of terms you may need to know:
- Personal injury claim: Legal dispute that is filed in court when a person suffers harm from an injury
- Multi-district litigation (MDL): Litigation that is comprised of multiple civil litigations
- Bellwether test trials: Test trials that result in a large number of lawsuits filed against one party: these test cases are done to give all parties involved an idea of the compensation each person should receive.
- Product Liability: Legal theory that holds a manufacturer liable for negligence
- FDA: Food and Drug Administration
Why Have Personal Injury Claims Been Filed Against Janssen Pharmaceuticals?
The drug Elmiron was approved by the FDA in 1996 for the treatment of IC. Since that time, studies have shown that as many as a quarter of the patients who have regularly used Elmiron has suffered vision problems.
The personal injury claims state that Jannsen Pharmaceuticals may have been aware of this serious side effect and withheld information from the public as well as the FDA as to the risks involved in taking this medication.
How Many Personal Injury Claims Have Been Filed Against Janssen Pharmaceuticals?
As of September 2022, there are a total of 1,740 claims currently pending in multidistrict litigation. The MDL, which was established in New Jersey in a US District Court, is being presided over by Judge Brian Martinott.
What Should I Know About the Elimiron Lawsuit Update?
At this time, only a timeline of court proceedings is available:
- January 2023: The first three bellwether test trials will begin.
- March 2023: The second bellwether case will begin.
- May 2023: The third and final bellwether case will begin.
Legal experts speculate that the MDL to determine settlements will be reached with a structured payout. This means that plaintiffs will receive compensation based on the severity of their injuries.
