Amid a long-running legal battle with Juul, a popular brand of e-cigarette, the FDA issued a ban in June 2022. Since that time, the U.S. Court of Appeals has blocked the ban, with Juul being allowed to continue selling its product. Here’s the latest Juul news as of July 2022.
Here’s the Food and Drug Administration’s Most Recent Move
After having placed a ban on the sales of Juul, the FDA has now issued a stay on that ban but says the stay does not mean the marketing denial order is being rescinded.
The burden now falls to Juul. In order to remain on the market, they must show that their e-cigarettes are not a public health hazard but instead a benefit to public health. They will need to prove two things.
First, Juul must show evidence that adults who use their e-cigarettes are likely to reduce tobacco use or altogether quit smoking.
The premise of Juul’s marketing is that they are a smoking alternative that will lead adult smokers away from regular cigarettes and combat underage usage of their e-cigarettes. This is a problem for the FDA.
The FDA has issues with Juul’s original application and states that Juul simply did not provide enough information so that health risks could be properly evaluated. Of course, Juul disagrees.
Secondly, Juul must prove that teens are unlikely to get hooked on their products. Recent statistics are showing quite a different story than what Juul claims, and that is especially disturbing when it comes to young people.
A study published in JAMA Pediatrics claims that the percentage of people ages 15 to 34 who had not previously used Juul doubled between 2018 and 2019.
In a 2019 National Youth Tobacco Survey, data showed that 27.5% of school-age kids vaped at least once in the past month, up from 20.8% in 2018.
With those numbers continuing to increase, it seems unlikely Juul is going to be able to stand by its original claim.
